Family Support

Family Support is an agreement between the parents, or an order or judgment, that combines child support and spousal support without designating the amount to be paid for child support and the amount to be paid for spousal support. (Family Code, section 92.)

Family support under California law was created as an alternative to traditional spousal and child support arrangements.  In a traditional support order, the paying party is required to pay separate amounts for child support and spousal support, with each amount calculated separately.  However, in a family support order or agreement, both forms of support are combined into a single payment, with no separate designation of amounts for each type of support.

One of the main benefits of family support is that it can provide a more flexible and simplified approach to support.  It allows the parties to avoid the complexity and costs of separate support orders, as well as potentially reducing the need for ongoing modification of support orders.  Additionally, family support can help to ensure greater financial stability for the supported party, as they receive a consistent payment that covers both forms of support.
